REALIVE End User License Agreement

This End User License Agreement (the "Agreement") is a legal agreement between you, the person who purchased REALIVE ("you"), and REALIVE ("REALIVE", "we", "us"). It governs your use of the REALIVE software package.
By installing, copying, importing or using REALIVE, you agree to this Agreement. If you do not agree, do not install or use REALIVE.
1. Definitions
- "REALIVE" or "the Software" means the REALIVE package, including its scripts, Lua source code, configuration files, templates, themes, documentation and any updates we provide. It does not include REAPER or the Third-Party Components.
- "REAPER" means the digital audio workstation software made by Cockos Incorporated.
- "Third-Party Components" means software made by others and distributed with REALIVE, such as REAPER extensions (for example SWS, ReaImGui and js_ReaScriptAPI). Each is governed by its own license.
- "Computer" means any computer or device you own or control.
2. License grant
When you purchase REALIVE, we grant you a personal, non-exclusive, non-transferable license to install and use REALIVE on as many Computers as you like, as long as you are the only person using it.
- One license, one person. Each license belongs to one individual. Other people, including bandmates, students, clients or co-workers, need their own license, even on a Computer you own.
- Any number of Computers. You may install REALIVE on all of your own Computers, such as a studio machine, a laptop and a backup rig for live shows.
- Backups. You may make copies of REALIVE for backup and archive purposes.
- Commercial use. You may use REALIVE for paid work, including live performances, rehearsals, recordings and productions.
The license is granted, not sold. We keep all rights not expressly granted to you in this Agreement.
3. Restrictions
You may not, and may not allow anyone else to:
- Share, give away, sell, rent, lend, sublicense or otherwise distribute REALIVE or your license, in whole or in part.
- Publish REALIVE, or any modified version of it, online or anywhere else, including file-sharing sites, forums, code repositories and package managers.
- Share your download links, license key or account access with anyone.
- Use REALIVE, or substantial parts of its code, to create a product that competes with REALIVE.
- Remove or change any copyright notice, license header or other proprietary notice in REALIVE.
- Remove, disable or get around any license check or protection measure in REALIVE.
You may share short code excerpts publicly when asking for help or reporting a bug, as long as you do not share enough to reproduce REALIVE or any substantial part of it.
4. Modifications
You may modify REALIVE's scripts and configuration for your own personal use. Modified versions remain subject to this Agreement and may not be distributed.
We do not provide support for problems caused by your modifications. Updates may overwrite your changes, so keep your own copy of anything you modify.
5. Feedback and contributions
If you send us bug reports, fixes, code, suggestions or other feedback, you grant us a free, perpetual, worldwide, irrevocable right to use, modify, include and distribute it in REALIVE or any other product, without payment or credit to you. You confirm that you have the right to give us what you send.
6. REAPER
REALIVE requires REAPER, which is sold separately by Cockos Incorporated. REAPER is not part of REALIVE, and this Agreement gives you no rights to REAPER.
- You must obtain and keep your own valid REAPER license, and follow the REAPER end user license agreement.
- REALIVE is an independent product. It is not made, endorsed or supported by Cockos Incorporated.
- REAPER is a registered trademark of Cockos Incorporated.
7. Third-Party Components
REALIVE may include or install Third-Party Components. Each Third-Party Component is governed by its own license, provided with REALIVE, and not by this Agreement. Nothing in this Agreement limits your rights under those licenses.
8. Updates and support
Your purchase includes the updates and support described at the time of purchase. We may change, add or remove features in updates. We are not required to provide updates, support or compatibility with future versions of REAPER, operating systems or Third-Party Components.
9. Ownership
REALIVE, including its code, design, documentation and name, is owned by REALIVE and protected by copyright and other intellectual property laws. You own your own projects, songs, recordings and settings created with REALIVE.
10. No warranty
To the maximum extent permitted by law, REALIVE is provided "as is" and "as available", without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that REALIVE will be error-free or uninterrupted.
REALIVE may be used in live performances. You are responsible for testing your setup before any performance, and for keeping backups and fallback plans.
11. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special or consequential damages, including lost income, cancelled or interrupted performances, lost data or damaged equipment, arising from your use of or inability to use REALIVE.
Our total liability under this Agreement is limited to the amount you paid for REALIVE.
Some jurisdictions, including Quebec, do not allow certain warranty exclusions or liability limits for consumers. In those cases, the exclusions and limits above apply only as far as the law allows, and nothing in this Agreement removes rights you have as a consumer.
12. Termination
This Agreement lasts until it is terminated. It ends automatically if you break any of its terms. When it ends, you must stop using REALIVE and delete all copies. Sections 5, 9, 10, 11 and 13 continue to apply after termination.
13. General
- Governing law. This Agreement is governed by the laws of the Province of Quebec and the federal laws of Canada that apply there.
- Changes. We may update this Agreement for future versions of REALIVE. The version provided with the copy of REALIVE you use applies to it.
- Severability. If any part of this Agreement is found unenforceable, the rest remains in effect.
- Entire agreement. This Agreement is the entire agreement between you and REALIVE about the Software.
- Language. Les parties ont exigé que la présente entente soit également disponible en français. The parties have required that this Agreement also be available in French.
